And lastly, though I’m against judicial activism and wish this was being handled outside the courts, I’m glad to see consideration given to better accommodating the downtrodden, even if the issue appears mundane.

I think the judge’s reasoning may be a bit naive on some points (“It’s only 5% of 4.2 billion dollars, after all”), and bench legislation bites, but heck, it’s a good idea. Now if we could just get the kooks on Capitol Hill to actually do something about this…
Agreed regarding the judge’s opinions… but we’re a country of innovative folks. Hopefully there is an affordable solution to be had.

Not sure on the money one. We all have limitations and the taxpayer shouldn’t be forced to even the world out. I don’t think it’ll even be even in Heaven.
It’s a typical legal response though isn’t, “He said he wouldn’t tell officials how to fix the problem, but he ordered them to begin working on it”. So many folk like to point out problems but expect others to fix them.
